By downloading or using Dincharya, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our App.

These Terms and Conditions ("Terms") govern your use of the Dincharya - Habit Tracker mobile application ("App") operated by Global Solutions Software ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the App.

2. Description of Service

Dincharya is a habit tracking application that allows users to:

  • Create and manage daily habits
  • Track habit completion and build streaks
  • View weekly and historical progress
  • Use home screen widgets for quick access
  • Receive reminder notifications

The App is provided free of charge with advertisements. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time.

3. User Accounts and Registration

The App does not require user registration or account creation. Your habit data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App.

4. User Conduct

When using the App, you agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App, its servers, or any related systems
  • Interfere with or disrupt the App's functionality or servers
  • Reverse engineer, decompile, or disassemble the App

We do not warrant that:

  • The App will function uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App will meet your specific requirements

The App is designed to help you track habits but does not guarantee any specific results, health improvements, or behavioral changes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Global Solutions Software, its directors, employees, partners, agents, suppliers, or affiliates be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damages resulting from unauthorized access to or use of our servers
  • Any damages resulting from interruption or cessation of transmission to or from the App
  • Any damages resulting from bugs, viruses, or similar harmful code transmitted through the App

10. Indemnification

You agree to defend, indemnify, and hold harmless Global Solutions Software and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

  • Your use of and access to the App
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including any intellectual property or privacy right

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms.

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Washington, D.C., without regard to its conflict of law provisions.

Any disputes arising from these Terms or the use of the App shall be resolved exclusively in the courts located in Washington, D.C.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Global Solutions Software regarding the use of the App, superseding any prior agreements between you and us.
